 Abstract 

The article is devoted to the deposit as a legal fact. It is noted that the deposit in civil legislation is not constructed at all as a legal fact, which the "sum of money" cannot be, but rather as an object of civil legal relations. As for the actual legal fact, it is represented by two elements: first, the agreement on the deposit, and secondly, the delivery (transfer) of the deposit. Since the debtor is obliged to pay the creditor a certain amount of money, there is no reason to deny that the transfer of part of this amount in the form of a deposit represents the performance of the debtor's duty, although not in full. Thus, the payment of the deposit is both the performance of part of the obligation and the enforcement of the rest of it. If the recipient of the deposit fails to fulfil the obligation, a new obligation arises to return double the amount of the deposit; in case of non-performance of the obligation by the payer of the deposit, a real-legal effect arises – the right of ownership of the amount of the deposit from the recipient. The main practical conclusion is that the deposit itself does not entail any independent legal consequences, but only in conjunction with the non-performance of the obligation by any of its subjects.
